What are psychosocial hazards?

Psychosocial hazards are workplace factors that can cause psychological or physical harm. They include excessive workload, low job control, bullying and harassment, workplace conflict, exposure to traumatic events, remote or isolated work, and fatigue. Under updated WHS laws, employers must identify, assess, and control these hazards the same way they manage physical safety risks.

Is this actually a legal requirement?

Yes. Every Australian state and territory now has WHS regulations that explicitly require employers to manage psychosocial hazards. Victoria commenced December 2025, NSW updated August 2025, and a national Code of Practice on sexual and gender-based harassment took effect March 2025. This is not optional. SafeWork regulators are actively enforcing.

What are the penalties for non-compliance?

Penalties for serious WHS breaches can reach $1.5 million or more for body corporates and $300,000 or more for individuals. Court Services Victoria was fined approximately $380,000 after a toxic workplace culture contributed to an employee death. SafeWork NSW issued 736 non-compliance notices to 261 employers in its largest compliance blitz on record. Regulators can also prosecute for Category 1 offences (reckless conduct) which carry imprisonment.

I already have a bullying policy. Is that enough?

Unlikely. A bullying policy covers one psychosocial hazard. The regulations require you to identify and manage all psychosocial hazards in your workplace, including workload, job demands, poor support, conflict, fatigue, and isolation. You need a risk assessment, documented controls, and evidence of worker consultation across all hazard types.

Does this apply to small businesses?

Yes. WHS obligations apply to all persons conducting a business or undertaking (PCBUs), regardless of size. If you have employees or contractors, you must manage psychosocial hazards. The scale of what is reasonably practicable differs based on business size, but the obligation exists for every employer.

Every industry with employees. However, some face higher psychosocial risk: healthcare and aged care (traumatic events, aggression), hospitality (long hours, fatigue, harassment), professional services (workload, burnout), education (conflict, emotional demands), construction (isolation, culture), and retail (customer aggression, shift work).

Do I need to consult with workers?

Accepted Answer

Question 8

How is this different from an Employee Assistance Program?

Accepted Answer

An EAP provides counselling after harm occurs. Psychosocial hazard management is about preventing harm in the first place by identifying and controlling workplace risks. Having an EAP does not satisfy your obligation to manage psychosocial hazards. You need both: prevention through risk management, and support through programs like EAPs.

Psychosocial hazards are now regulated. Every employer needs documented controls.

A bullying policy is not enough. You need a complete psychosocial hazard management system.
